Palfrey: Know Your Copy-Rights

Indeed: In the UK, under the CDPA 1988 section 30 rather ambiguously provides that:
“(1) Fair dealing with a work for the purpose of criticism or review, of that or another work or of a performance of a work, does not infringe any copyright in the work provided that it is accompanied by a sufficient acknowledgement.
(2) Fair dealing with a work (other than a photograph) for the purpose of reporting current does not infringe any copyright in the work….”
How does this exception apply where governments use national security argument and impose “gagging orders”. Is there one “can-copy” rule for day to day matters and another for “can’t-copy” where the information is perceived as threatening the political institution. Suddenly the Statute of Anne seems so tame. Taming the Horse?
