Did Killings Violate Executive Order?

"Executive Order 12333 — United States intelligence activities:

2.11 Prohibition on Assassination. No person employed by or acting on
behalf of the United States Government shall engage in, or conspire
to engage in, assassination."

An
AP wire story
says that the killing of Odai and Qusai Hussein
violates this Executive Order banning assassinations.  Eugene
Volokh has a thing or two to say about that…
