When it comes to muzzling the famous 1-(800)-PIT-BULL, the Florida Bar is all bark, and no bite. After more than two hours of testimony and argument yesterday (Sept. 14, 2004), the Hon. William W. Herring, the referee/judge hearing the Florida Bar’s case against Fort Lauderdale’s Pape & Chandler, ruled that neither the 800-PIT-BULL telephone number, nor the firm’s pit bull logo, violated the ethical Rules of the Florida Bar, which were found to be unconstitutional as applied in this case.
Marc Chandler was kind enough to fill us in after their victory yesterday — a win made sweeter by the fact P&C appeared pro se and the judge had clearly absorbed the parties’ voluminous pleadings. The decision and pleadings in State of Florida v. John Robert Pape and Marc Andrew Chandler will soon be available at P&C’s website. Marc wonders whether the Florida Bar will publish “this decision with the same enthusiasm that they published articles ridiculing our telephone number over the last 3 months” (e.g., here)

- Your Editor is left asking the same question he had 25 years ago in law school: When will the profession see that it will earn the respect of the public through the personal integrity of lawyers and the provision of quality services for reasonable fees — not through some phony notion of “dignity” or by treating the public like children? [but see, N. O. p/i lawyer David Bend, who decries "tacky" lawyer advertising.]
