Letter from Munich – the Joseph Affair – 67

Dear Mr. Graf, dear friends,
Francesca showed us a copy of a document that was written out in a very childish style and in a child’s handwriting. This handwriting was almost illegible, but she managed to read the document to us anyway.
I will write out what she read, exactly as it was originally written, but in the English version below, I will not attempt to reproduce all of the numerous errors in spelling, grammar, and vocabulary that the then twelve-year-old author made in the original German.
“I, Sven May, born on 16 July 1987 in Sebnitz heard how Maik Hauke, Rony Kunte, Rene Grossmann, Kai Bleche and other grown-ups spoke to Joseph in a loud voice. It was so loud that everybody could hear it. ‘We’re going to kill you now, you shit-foreigner.’ They called him ‘Abdulla.’ Joseph said nothing. He was lying on the ground. The fat man from the snack bar stood at the corner of the swimming pool and didn’t do anything. Frau Goebel, the fat pool guard, sat in the control room and closed the door. They threw Joseph in the water. Four men stood on top of Joseph. Maik Hauke, Rony Kunte, Rene Grossmann, and Kai Blechke stood on him about seven (times). The fat man from the snack bar watched. Then they left. After they left Frau Goebel came back. And (she) later saw Joseph on the ground. Joseph lay there lifeless. My brother Rene then went home because he was afraid. When they pushed Joseph under the water, Joseph struggled and tried to gasp for air. He didn’t cry out. He defended himself, weakly. Maik Hauke had hit Joseph really hard on the right ear with the flat of his hand.”
Below this paragraph is written the signature: “Sven May, 3 August 1999, in Sebnitz. I spoke with Diana on a cassette and told everything.”
What is important here,” Francesca said to us, “is not only the statement that the boy wrote out, but the way he expressed it. I’m talking about the many grammar errors (in the original German) and the other mistakes. They are the kind of mistakes, together with the child’s handwriting, that give the document an air of authenticity, in my opinion.”
Someone asked about the cassette that the boy mentioned in his statement.
“This cassette is part of what the Dresden district attorney’s office seized eighteen months ago, when its representatives visited the home of the Kantelberg-Abdullas in Sebnitz and gathered the pieces of ‘evidence’ that they could use in charging the parents with ‘spreading false suspicions.’”
She was silent for a moment and then added, “It goes without saying that not a single piece of evidence has been returned to the parents.”
“In Germany,” someone asked, “is it normal for a district attorney’s office to confiscate evidence that the accused needs to prove his or her innocence?”
Francesca laughed. “In Germany,” she said, “everything is normal, if it serves rightly or wrongly to ‘demonstrate’ the innocence of someone in authority, whether that person is a politician, or a doctor who makes a mess of an operation on a poor Turkish woman in Bavaria, or government officials who mishandle the investigation of a murder, or the leading citizens in a small town in eastern Germany, who try to protect some of their own.”

Bitte vergessen Sie nicht, dass der Autor dieses Briefes Autodidakt ist, was die deutsche Sprache betrifft, und er weiß, dass, wenn es um eine Übersetzung aus der deutschen Sprache ins Englische geht, viele Fehler hervortreten müssen. Er hofft aber, man werde diese Fehler übersehen, um hinter den Fehlern das sehen zu können, was in diesem Schreiben und in dieser Affäre von zentraler Bedeutung ist.

Sehr geehrter Herr Graf, sehr geehrte Freunde,
Francesca zeigte uns heute eine Kopie eines Dokumentes, das auf eine sehr kindische Art und Weise geschrieben wurde. Die Handschrift war fast unlesbar, aber sie schaffte es trotzdem, uns das Dokument vorzulesen.
Ich werde alles ausschreiben, was sie vorlas, genauso wie es ursprunglich geschrieben wurde, mit all den Fehlern, die der damals zwölfjährige Autor gemacht hat.
„Ich Sven May geboren am 16.7.87 in Sebnitz habe gehört wie Maik Hauke, Rony Kunte, Rene Grosmann, Kai Bleche und andere Große laut zu Joseph sagten alle konnte es hören so laut war es. Jetzt bingen wir dich um du scheis Ausländer. Sie haben auch den namen Abdulla gesagt Joseph hat nichts gesagt. Er hat am boden gelegen. Der Dicke mann vom Choso, hat an der Ecke am Schwimmbecken dabeigestanden und hat nichts getan Frau Göbel, die Dick aufpasserin hat im Konndrollraum gesesen und hate die Tür zu. Sie haben Joseph ins wasser gestossen. vier Mann haben sich auf Joseph daraufgestellt. Maik Hauke, Rony Kunte, Rene Grossman Kai Blechke ungefer 7 daraufgestanten. Der Dicke Mann vom Choso hat zugeschaut. Dann sind sie Abgehauen. Wo sie dann Abgehauen sind kamm Frau Gobel zurück. Und hat später Joseph am Grund gesehen. Joseph lag leblos da. Mein Bruder Rene ist zu diesen Zeitpunkt nach Hause gegangen weil er Angst hate. Als sie Joseph unntertauchten hat Joseph gestrampelt und fersucht nach luft zu Schnapen er hat nicht geschriehen. Er hat sich schwach gewert. Maik Hauke hate Joseph auf das Rechte Ohr ganz stark gehauen mit der Flachen Hand.“
Weiter unten steht es: Sven May am 03.08.99 in Sebnitz Ich habe mit Diana schon auf Kasete gesproche und alles erzählt.“
„Das, was hier wichtig ist,“ sagte uns Francesca, „ist nicht nur die Erklärung, die der Junge ausgeschrieben hat, sondern die Art und Weise, wie er alles ausdruckte. Ich spreche von den zahlreichen grammatischen und anderen Fehler. Es sind die Art Fehler, die, zusammen mit der kindischen Handschrift, dem Dokument etwas Authentisches verleihen, meiner Meinung nach.“
Irgendjemand fragte nach der Kassette, die der Junge in seiner Aussage erwähnte.
„Diese Kassette ist ein Teil davon, was die Staatsanwaltschaft vor achtzehn Monaten beschlagnahm, als ihre Vertreter das Haus der Kantelberg-Abdullas in Sebnitz besuchte und jeden sogenannten ‚Beweisstück’ aufsammelte, mit dem sie Josephs Eltern wegen der ‚Verbreitung falscher Verdächtigungen’ anklagen konnten.“
Sie schwieg einen Augenblick und dann fügte hinzu, „Es versteht sich von selbst, dass kein einziger Beweisstück den Eltern bis jetzt zurückgegeben würde.“
„In Deutschland,“ fragte jemand, „ist es normal, dass die Staatsanwaltschaft die Beweisstücke der Angeklagten beschlagnimmt, die die Angeklagten brauchen, um ihre Unschuld zu beweisen?“
Francesca lachte. „In Deutschland,“ sagte sie, „alles ist normal, was dazu dient, die Unschuld der Obrigkeit zu ‚beweisen,’ richtig oder falsch und egal ob sie Politiker sind, oder einer Arzt, die das Körper und das Leben einer armen türkischen Frau in Bayern verpfuscht, oder Beamte, die die Untersuchung eines Mordes schlecht abwickeln, oder die führenden Bürger einer Kleinstadt im östlichen Teil der Bundesrepublik, die versuchen, einige der Ihren zu schützen.“
