Dear Mr. Graf, dear friends,

Last week Francesca read to us a portion of the transcript of another judicial interrogation in the matter of the investigation into the death of the child Joseph Abdulla. The witness was a young boy from Sebnitz. The transcript has the Dresden district court file number 270 Gs 3141/00 414 Js 53329/00; the interrogation was carried out on 21 November 2000, at ten o’clock in the morning.

Francesca continued with the reading from where she ended last week:

In response to the question as to why he doesn’t want to make any statements before the court or to the police: “It’s because of the right-wing scene.”

In response to a question about Joseph’s mother giving this information to the press as well: “No, she won’t do that. I put a lot of trust in her.”

In response to a question about Frau Dr. Kantelberg doing everything for frivolous reasons: “I understand Frau Kantelberg. We already went to see a lawyer in Munich, with Frau Kantelberg of course. My mother and I, Diana and Frau Kantelberg’s husband were also there.”

In response to a question about how that came about: “They just said, ‘We have to go see a man in Munich,’ someone she knew. Then she came by one day at five o’clock in the morning, and my mother made me go along.”

In response to a question about whether he was promised anything for doing that: “Little Rene May was already involved too. They got some money for making a statement, even a statement to Frau Kantelberg.”

In response to a question about his own situation: “No, I didn’t get anything.

“We went to Munich for a day, talked, and came right back. We went in Frau Dr. Kantelberg’s car.”

In response to a question about whether or not he knew if his mother was promised anything: “Anyway, I know about the Mays, they got something. Rene and Sven said that.”

In response to a question: “I didn’t get any money. If I wanted some cough drops, I got them for free.”

In response to a follow-up question: “I did get money once. It was fifty marks. I got it from Joseph’s father, Herr Abdulla.”

In response to a question about who explained to him what a statement under oath means: “Frau Kantelberg. I said to Frau Kantelberg that I didn’t want (to do) that, that it should be done publicly. They promised me – Frau Kantelberg – that it wouldn’t be made public, that no names would appear.”

In response to a follow-up question: “Yes, they lied to me about that.”

Page 287 was shown to the witness, from the point where it states, “Mr. Lehmbruck, attorney-at-law, said . . .” (and the witness responded): “He said that to me too. I always said that to him about the right-wing people. He said, we can do it in such and such a way.”

In response to a question about how much fear he had: “A lot. I wouldn’t hide now. They’d really come after me. They’ll go so far as to run me over.”

In response to a question about who he meant: “(Name withheld) and I don’t know the groups so well. There’s a guy named Richter that’s one of them, and he has something to do with them, but he’s really one of the small fry. It goes a lot higher.”

In response to a question about whether he knows anyone else: “The ones in the swimming pool. Mahler, Krause.”

In response to a question about whether anyone had ever threatened him: “Not really threatened exactly, but I know what these guys have in mind.”

In response to a question about why no one has gone to the police in Sebnitz: “Because some of the policemen there, like Kriedel and Biegus, can’t keep their mouths shut. Guys like that spill everything right away. Who said this and who said that.”

In response to a question about how he knew that: “Because something like that happened once to me.”

In response to a question about the police and right-wing extremists: “I know that even the police are with the right wing. I know that. A person really sees that with Kriedel. A person notices it in those people somehow. A person notices it in the way they talk. Either you say this, this, and this, or you’re finished. It’s the way they behave, or the way sit in their car sometimes, with short hair.”

In response to a follow-up question: “Short hair, real skinheads, and the fact that they talk like right-wing extremists.”

In response to a question about hatred of foreigners: “Yeah, that too.”

In response to a question from district attorney Flockerzi about how the first statement for Frau Kantelberg came about: “With Frau Kantelberg, in the apartment. Frau Kantelberg came to our apartment and I came in from outside. Then she started in about whether I knew anything, and her voice was really loud.”

Then Francesca said to us, “At this point in the transcript it states that the questioning session was interrupted from 10:50 to 10:55 a.m.”

Sehr geehrter Herr Graf, sehr geehrte Freunde,

Francesca hat letzte Woche einen Teil eines Protokolls uns vorzulesen. Es war das Protokoll noch einer richterlichen Zeugenvernehmung in der Todesermittlugnssache des Kindes Joseph Abdulla, Geschäftszeichen des Amtsgerichts Dresden: 270 Gs 3141/00 414 Js 53329/00, am 21.11.2000 um 10.00 Uhr durchgeführt.

Sie fuhr mit dem Vorlesen fort, wo sie letzte Woche aufgehört hat:

Auf Frage, warum er bei Gericht und der Polizei keine Aussage machen will: Das ist eben wegen der rechten Szene.

Auf Frage, dass die Mutter des Joseph dies auch an die Presse geben hätte können: Nein, das macht sie nicht. Ich habe ihr eben vertraut.

Auf Frage, dass das Frau Dr. Kantelberg ja nicht zum Spass gemacht hat: Ich verstehe Frau Kantelberg schon. Wir waren ja schon in München bei einem Anwalt mit der Frau Kantelberg natürlich. Ich und meine Mutter, die Diana und der Ehemann von Frau Kantelberg waren da mit.

Auf Frage, wie das zustande kam: Die haben einfach gesagt, wir müssen zu dem Mann nach München, da sie den kenne. Dann kam sie irgendeinen Früh 05:00 Uhr und meine Mutter bestand darauf, dass ich mitfahre.

Auf Frage, ob ihm dafür was versprochen wurde: Der kleine Rene May war auch schon dran. Die haben Geld dafür bekommen, wenn sie etwas aussagen. Auch bei der Frau Kantelberg.

Auf Frage, wie es bei ihm war: Nein, ich habe nichts bekommen.

Nach München sind wir einen Tag hingefahren, geredet und gleich zurück. Das war mit dem Auto von Frau Dr. Kantelberg.

Auf Frage, ob er vielleicht nicht weiß, ob seiner Mutter was versprochen wurde: Auf alle Fälle weiß ich das von den May’s, die was bekommen haben. Das hat der Rene und der Sven gesagt.

Auf Frage: Ich habe keine Geld bekommen, wenn ich Hustenbonsel wollte, habe ich die umsonst bekommen.

Auf Nachfrage: Ich habe einmal Geld bekommen. Das waren 50,00 DM. Das habe ich von dem Vater von dem Joseph bekommen, dem Herrn Abdulla.

Auf Frage, wer ihn belehrt hat, was eine eidesstattliche Versicherung ist: Frau Kantelberg. Frau Kantelberg habe ich gesagt, dass ich das nicht möchte, dass es öffentlich gemacht wird. Da haben die mir versprochen, die Frau Kantelberg, dass das nicht an die Öffentlichkeit kommt, es sollten keine Namen auftauchen.

Auf Vorhalt: Da haben die mich ja angelogen.

Blatt 287 wird dem Zeugen vorgehalten, ab „Herr RA Lehmbruck erzählte . . .“: Das hat er zu mir auch gesagt. Da habe ich ihm das immer gesagt mit den Rechten. Da sagte er, das können wir so und so machen.

Auf Frage, wie groß die Angst ist: Ganz schön. Ich würde mich jetzt nicht verstecken. Sie würden mich förmlich verfolgen. Die gehen so weit, dass die mich über den Haufen fahren.

Auf Frage, wen er meint: SSS und ich kenne die Gruppen auch nicht so. Dazu gehört dieser Richter, der hat was damit zu tun aber das ist nur ein ganz kleiner Fisch. Das geht dann auch noch höher.

Auf Frage, ob er noch jemanden kennt: Die im Bad waren. Mahler, Krause.

Auf Frage, ob ihn schon einmal jemand bedroht hat: Bedroht nicht so richtig aber ich weiß, was die Kunden drauf haben.

Auf Frage, warum Keiner zur Polizei in Sebnitz gegangen ist: Weil dort einige Polizisten sind, wie Kriedel und Biegus, die nicht ihren Mund halten können. Das sind solche Kunden, die eben gleich alles weiter quatschen. Der hat das gesagt and der hat das gesagt.

Auf Frage, woher er das weiß: Weil das schon einmal so bei mir war.

Auf Frage, was mit der Polizei und den Rechten war: Ich weiß, dass auch Polizisten bei den Rechten sind. Das weiß ich. Beim Kriedel sieht man das förmlich. Den Leuten merkt man das irgendwo an. Das merkt man an seinem Gerede. Entweder du sagst das, das und das oder du gehst ab. Wie sie auftreten oder wie sie manchmal im Auto sitzen, mit den kurzen Haaren.

Auf Vorhalt: Kurze Haare, richtig Glatze und dass sie eben schon wie Rechte reden.

Auf Frage, ausländerfeindlich: Ja auch.

Auf Frage Herr StA Flockerzi, ob die erste Aussage mit Frau Kantelberg stattfand: Bei Frau Kantelberg in der Wohnung. Frau Kantelberg kam in unsere Wohnung und ich kam von draußen rein. Sie fing dann an, ob ich etwas wüsste und die Tonart wurde dann schon laut.

Die Sitzung wurde von 10.50 Uhr bis 10.55 Uhr unterbrochen.
